International aviation law clearly enshrines the right to reimbursement of the cost of the plane ticket. However, many passengers say the companies are doing all they can to get around the law, using inappropriate means. So what can be done anyway?

Besides those passengers whose flight was canceled by the Tunisair company, there are also those who canceled the flight themselves and are entitled to a refund according to the law, when the flight is canceled within 14 days of booking. or in the case of seniors, the withdrawal period is 4 months. In these cases, too, the law requires that the money be returned to the customer – and neither is it.

Services are provided to the passenger whose flight has been canceled or departed two to five hours late.

Assistance services, which include food and drinks depending on the waiting time for the next flight, communication services, accommodation and transfer services to and from the airport in the event of a stay of one or more nights until the next flight. Eligibility for accommodation services is limited to 2 nights.

Instead of a refund, Tunisair can offer the passenger a plane ticket or a replacement voucher. The airline must inform the passenger of their right to choose between a refund and an alternative airline ticket or credit voucher.

A passenger, who has not informed their air carrier that they are interested in one of the alternatives, will receive a refund.

In the event that the flight has been booked by a travel agency and the agency has received payment for the benefit, it must transfer it to the passenger.

How to get reimbursed by Tunisair?

The Tunisian carrier must reimburse the total amount paid for the air ticket, including any payment paid for the flight, including fees, surcharges, taxes and other obligatory payments.

If the ticket was issued as part of a vacation package, its price will be calculated based on flight distance, flight type and class of service type.

The passenger will receive the refund within 90 days from the date stated on the plane ticket.

Credit voucher for canceled flight

The voucher must correspond at least to the total amount of the consideration paid for the original air ticket. In this case, the Tunisian airline must issue the voucher within 14 days from the day it received the passenger’s consent to receive a voucher, or when it had to reimburse the passenger (if he did not not accepted to receive a voucher), whichever comes first.

The credit voucher will be valid for at least one year. The voucher can be used for the purchase of any service offered by the airline, as well as for services that must be provided after the validity period of the voucher.

A passenger who has received a credit voucher can transfer it to another person.

If the passenger has not exchanged the credit voucher during the validity period of the voucher, or if they have only exchanged part of it, they will be entitled to receive the consideration paid for the original airline ticket, or its balance.

To receive the return, you must contact the airline 21 days before the voucher expires.

The airline must return the consideration to the passenger within 21 days from the day the passenger contacted them.

Important information

Different flights may be subject to different rules, depending on the destination of the landing or take-off. In some cases, several laws may apply to the same flight, and the passenger will have to choose under which law to request the benefit. It is advisable to check with the airline which benefits the passenger is entitled to in the event of flight cancellation.

In the case of flights that took off during the corona crisis period 8 to 5 hours late or were delayed by more than 8 hours, the passenger will be entitled to a refund or an alternative air ticket, depending on the conditions listed above. The passenger will not be entitled to additional monetary compensation.

ALTERNATIVE PLANE TICKET

A replacement air ticket must have the same destination as the canceled flight, under conditions as similar as possible to the conditions of the original air ticket, and as soon as possible, or at a later date in coordination with the passenger.
