The service implies the obligation to provide free of charge, in case of cancellation or delay – if it is delayed for at least two hours on flights of less than 1500 km; three hours on European flights over 1,500 km or between 1,500 and 3,500 km elsewhere; or four hours in the rest of the cases – enough food and drink according to the wait, communication by telephone or mail, hotel accommodation if you have to stay overnight and transport between the airport and the hotel.

If the flight has not been canceled but it is impossible for the traveler to get to the airport, it should be checked in the terms and conditions of the contract whether there is a possibility of canceling the trip or s ‘there is an alternative to postpone or cancel. Is there a right to compensation?

Under no circumstances will there be a right to compensation if the cause of the delay or cancellation is not due to extraordinary circumstances which could not have been avoided even if the carrier had taken all reasonable measures. How much can you claim from Nouvelair in the event of a flight delay?

Any delay does not entail financial compensation, which will depend, in terms of operation and amount, on the delay with which you arrived at your destination compared to the scheduled time and on the distance to be covered by the flight, also influence the actions taken by the airline in managing the incident.

Thus, there are some cases where the airline will not compensate but will have to provide assistance or make certain offers. Likewise, there are other cases in which, in addition to assistance, you will be entitled to compensation:

In the event that the airline has offered you (and this could prove it), the possibility of being driven to your final destination in an alternative transport with a difference in arrival time compared to that planned for the originally booked flight:

  •  2 hours or less, for all flights of 1,500 kilometers or less;
  •  3 hours or less, for all intra-Community flights over 1500 kilometers and for all other flights between 1500 and 3500 kilometers;
  •  Less than 4 hours, for all flights not included.

Your compensation is as follows:

250 euros for short distance flights,
400 euros for medium distance journeys
600 euros for long-haul flights.

If the delayed flight was a connecting flight purchased with the same plane ticket, the arrival time at the final destination (arrival time of the last flight) is the one used to estimate the delay time. However, if you have booked different flights individually, you are not entitled to claim compensation for flight delays on connections.

Although Regulation 261 does not contemplate financial compensation in addition to the provision of assistance in the event of delay, European case law has ruled that passengers on a delayed flight are entitled to compensation if the delay causes them to delay. Miss their connecting flight and, as a result, arrive at their final destination with a delay of three hours or more.

Regulation 261/04 also covers loss of connection, denied boarding on flights and cancellations you have suffered in the past five years.

As a reminder, you are eligible to claim compensation from Nouvelair only if your flight has been delayed on departure from an airport in the European Union.
